This warranty excludes
normal wear items (otherwise referred to as
consumables) including brake linings, brake
drums, tires, decking and light bulbs unless
these items have defective materials which
are manifested within 30 days of purchase.
Tires and any other component or consumable
which have separate manufacturers warranties
are subject to those warranties through the
retailer or manufacturer warranty
procedures.
Remedies under this warranty are explicitly
limited, at Gem State's option, or per
manufacturer's instructions, to replacement
or repair at Gem State Manufacturing Inc.,
1705 Industrial Way Caldwell Id. 83605, or
at a service facility to be designated by
Gem State and only after inspection of the
allegedly defective part
Gem State Manufacturing shall not be liable
for consequential damages of any kind,
including, but not limited to costs of
labor, transportation or repair of defective
parts or loss of income.
Any warranty, statutory or implied, as to
merchantability or suitability for a
particular purpose, shall be limited to the
duration of this warranty. We do not make
nor do we authorize others to make any other
express warranty on our behalf.
Gem State Manufacturing shall not under any
circumstances be held liable or responsible
for injuries to persons or property arising
out of, or in connection with willful or
negligent misuse of Gem State
Manufacturing's trailer or component parts,
regardless of whether the product is being
operated within or beyond its rated
capacity.
Gem State Manufacturing excepts no
responsibility for alternations,
modifications or structural repairs unless
authorized by our engineering department in
writing. Unauthorized alternations,
modifications or structural repairs shall
void this warranty.
Gem State Manufacturing takes no
responsibility for tow vehicle hitch
selections or electrical and plumbing
requirements provided to the trailer.
